Welcome to Texas Notary 360. These Terms of Service ("Terms") govern your use of our notary services and website. Please read these terms carefully before using our services.

By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

Acceptance of Terms

By accessing or using the services provided by Texas Notary 360 ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

These terms apply to all users of our services, including mobile notary services, Remote Online Notarization (RON), and any other notarial services we provide.

We reserve the right to modify these terms at any time. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

Services Provided

Texas Notary 360 provides professional notary public services, including but not limited to:

• Mobile notary services (we come to your location)

• In-office notarization

• Remote Online Notarization (RON)

• Real estate closings and loan signings

• Legal document notarization

• Powers of attorney

• Vehicle title transfers

• Wills and trusts

• Business documents

All services are performed in accordance with Texas state law and notary regulations.

User Responsibilities

When using our services, you agree to:

• Provide accurate and complete information

• Present valid, government-issued identification

• Ensure all documents are complete and ready for notarization

• Be present and willing to sign documents in the notary's presence

• Pay all applicable fees for services rendered

• Comply with all applicable laws and regulations

• Not use our services for any illegal or fraudulent purpose

• Maintain the confidentiality of any login credentials for RON services

Fees and Payment

Fees for our services are as follows:

• Mobile Notary: $75 per trip (up to 3 signatures)

• In-Office Notarization: $25 per signature

• Remote Online Notarization (RON): $50 per session

• Additional signatures: $10 each

• After-hours service: Additional $25

• Travel beyond 20 miles: Additional $1 per mile

Payment is due at the time of service. We accept cash, credit cards, and digital payment methods. All fees are non-refundable once services are rendered, except in cases where we are unable to complete the notarization due to our error.

Cancellation and Rescheduling

If you need to cancel or reschedule an appointment:

• Cancellations made 24 hours or more in advance: No charge

• Cancellations made less than 24 hours in advance: $25 cancellation fee

• No-shows: Full service fee charged

We reserve the right to cancel or reschedule appointments due to emergencies, weather conditions, or other unforeseen circumstances. In such cases, we will notify you as soon as possible and work with you to reschedule.

Notarial Acts and Limitations

As a Texas notary public, we are authorized to perform notarial acts as defined by Texas law. However, we cannot:

• Provide legal advice or draft legal documents

• Notarize documents if we have a personal interest in the transaction

• Notarize incomplete documents

• Notarize documents for individuals who cannot provide proper identification

• Notarize documents for individuals who appear to be under duress or lack mental capacity

• Notarize documents that appear to be fraudulent or illegal

We reserve the right to refuse service if we believe a notarization would be improper or illegal.

Remote Online Notarization (RON)

For RON services, additional terms apply:

• You must have access to a device with a camera, microphone, and internet connection

• You must present a valid government-issued photo ID during the video session

• The video session will be recorded and stored as required by Texas law

• You must be physically located in a jurisdiction where RON is legally recognized

• Technical issues may require rescheduling; we are not liable for technology failures

• You are responsible for ensuring your documents are properly uploaded and accessible

Confidentiality and Privacy

We maintain strict confidentiality regarding all notarial acts and client information. However, we may be required to disclose information:

• As required by law or court order

• To comply with legal processes

• To protect our rights or the rights of others

• In response to lawful requests by public authorities

Record Keeping

In accordance with Texas law, we maintain records of all notarial acts, including:

• Date and time of notarization

• Type of notarial act performed

• Type of document notarized

• Identification information of the signer

• Fee charged

These records are kept for the period required by Texas law and may be subject to inspection by authorized officials.

Liability and Disclaimers

Our services are provided "as is" without warranties of any kind. We are not liable for:

• The legal effect or validity of documents we notarize

• Errors or omissions in documents prepared by others

• Consequences arising from the content of notarized documents

• Delays or failures due to circumstances beyond our control

• Technical issues with RON platform or third-party services

Our liability is limited to the amount of fees paid for the specific service in question. We maintain errors and omissions insurance as required by Texas law.

Indemnification

You agree to indemnify and hold harmless Texas Notary 360, its owner, and affiliates from any claims, damages, losses, or expenses arising from:

• Your use of our services

• Your violation of these terms

• Your violation of any law or regulation

• Any false or misleading information you provide

• Any fraudulent or illegal activity

Intellectual Property

All content on our website and in our materials, including text, graphics, logos, and images, is the property of Texas Notary 360 or its licensors and is protected by copyright and trademark laws.

You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of the State of Texas, without regard to conflict of law principles.

Any disputes arising from these terms or our services shall be resolved through:

1. Good faith negotiation between the parties

2. Mediation, if negotiation fails

3. Binding arbitration in Harris County, Texas, if mediation fails

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
